Our Terms of Service
EasyHealth’s Terms of Service are organized into fifteen focused sections—Scope & Updates; Legal & Liability; Account & Eligibility; User Conduct; Data Control & Privacy; Security & Compliance; and Wrap-Up (international, feedback, and legal contact). They explain how you register, manage your account, and agree to updates; what conduct and usage standards apply; and how we handle your personal and health data. They outline our data storage, deletion, and retention policies; privacy protections under laws such as GDPR and CCPA; and your rights to access, export, or erase information. They also set forth governing law, arbitration procedures, liability limitations, breach notifications, and dispute resolution. Altogether, these Terms define your rights and obligations when using EasyHealth’s personal health tracking and wellness monitoring services.

1. Introduction & Acceptance
1.1 Overview
Welcome to EasyHealth: Vitals Tracker (“EasyHealth,” “we,” “us,” or “our”).
These Terms of Service (“Terms”) constitute a binding legal agreement between you (“you,” “your,” or “User”) and EasyHealth regarding your access to and use of the EasyHealth mobile application, website, software, digital tools, and all related services, features, and content (collectively, the “Services”).
By downloading, accessing, installing, registering for, or otherwise using any part of the Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms, along with our Privacy Policy and any supplemental terms or policies that may apply. These Terms apply to all forms of access and usage, including through mobile devices, web browsers, APIs, or third-party integrations, and they govern both free and paid functionality within the EasyHealth ecosystem.
Your use of the Services signifies your full and unconditional acceptance of these Terms. If you do not agree, you must immediately discontinue access and delete your EasyHealth account. Continued use of the Services after any updates to these Terms constitutes your reaffirmation of acceptance.
1.2 Purpose of the Agreement
This Agreement defines the legal relationship between you and EasyHealth and establishes the rules governing your use of our health tracking and wellness management platform. It explains your rights and responsibilities as a user, outlines our obligations to protect your data and privacy, and clarifies the limitations of our liability.
EasyHealth provides tools that allow users to record, track, and visualize personal health metrics such as blood pressure, cholesterol, glucose levels, weight, and other manually entered vitals. The Services are designed for informational and educational purposes only and do not constitute medical advice, diagnosis, or treatment. You should always consult qualified healthcare professionals before making medical decisions based on data displayed within the app.
1.3 Binding Nature of These Terms
By creating an account, logging in, or otherwise interacting with the Services, you agree that:
You are entering into a legally binding contract with EasyHealth under applicable law.
You will comply with all applicable laws, rules, and regulations while using the Services.
You have the legal authority to enter into this agreement personally or on behalf of another entity (if applicable).
You have read and accepted our Privacy Policy, which governs how we handle personal and health-related information.
If you are using EasyHealth on behalf of an organization, employer, or institution, you represent and warrant that you have been duly authorized to bind that entity to these Terms, and “you” and “your” shall refer collectively to both you and such entity. In such cases, the entity remains fully responsible for compliance with these Terms.
1.4 Acceptance Through Use
Your acceptance of these Terms is automatic and irrevocable once you:
Install or launch the EasyHealth app;

Continue to use any feature of EasyHealth after publication or modification of these Terms.
No separate signature, written agreement, or manual acceptance is required. By performing any of the above actions, you acknowledge that you have reviewed, understood, and consented to the entirety of these Terms.
1.5 Updates, Modifications, and Notice

Posting the revised Terms within the app or on our website;
Displaying an in-app notice, banner, or modal alert;
Sending an email or push notification to your registered contact information.

If you disagree with any changes, you must immediately discontinue use and close your account.
1.6 Relationship Between Terms & Privacy Policy
These Terms are complemented by our Privacy Policy, which explains in detail how we collect, use, process, and protect your personal and health information. The Privacy Policy is an integral part of this Agreement, and by accepting these Terms, you also accept and consent to the practices described therein.
If there is any inconsistency between these Terms and the Privacy Policy, the provisions of the Privacy Policy shall govern with respect to data privacy, while these Terms shall govern all other matters related to your access and use of the Services.
1.7 Authority, Eligibility, and Responsibility
By using EasyHealth, you confirm that:
You are of legal age to form a binding contract (13+ in most regions, 16+ where required by law);

You will use EasyHealth only for lawful, personal health-tracking purposes.

EasyHealth disclaims any liability for losses arising from unauthorized use due to your failure to secure your login credentials.
1.8 Interpretation and Precedence
These Terms supersede any prior agreements, representations, or understandings—oral, written, or implied—between you and EasyHealth regarding your use of the Services. No informal statement or communication from support, marketing, or social media constitutes a waiver or modification of these Terms.
In case of conflict between translated versions, the English version of these Terms shall control.
1.9 Your Acknowledgment
By continuing to use EasyHealth, you acknowledge that you:
Have read and understood these Terms in full;
Accept them voluntarily without coercion or misrepresentation;
Agree that your use of the Services constitutes ongoing acceptance of all obligations and limitations contained herein.
If you do not agree, do not install, access, or use EasyHealth in any manner.
2. Definitions
2.1 Purpose of Definitions
For clarity and consistency, the following capitalized terms shall have the meanings set forth below when used throughout these Terms of Service (“Terms”), our Privacy Policy, or any supplemental policies, guidelines, or legal notices issued by EasyHealth. means any vitals, wellness metrics, or manually entered measurements submitted through the Services, including but not limited to blood pressure, heart rate, blood glucose, cholesterol levels, weight, body-mass index, medication records, activity data, or related personal health indicators. “Applicable Law”
means all laws, statutes, regulations, directives, and ordinances that govern your use of the Services, including data protection and consumer rights legislation (e.g., GDPR for EU users, CCPA for California residents).
2.3 Interpretation Guidelines
Headings and numbering are for convenience only and shall not affect interpretation.
References to “include,” “including,” or similar terms shall be interpreted as “including without limitation.”
In the event of any inconsistency between these Definitions and the Privacy Policy, the Definitions herein shall control for general interpretation, while the Privacy Policy shall govern the treatment of personal data.
3. Changes to the Agreement
3.1 Right to Modify
EasyHealth: Vitals Tracker (“EasyHealth,” “we,” “us,” or “our”) reserves the sole and absolute right, at any time and in our sole discretion, to modify, amend, revise, or replace these Terms of Service (“Terms”) and any associated policies—including our Privacy Policy, Subscription Terms, or other legal documents—to reflect changes in technology, features, applicable law, or business practices.
We may also introduce new services, modify existing functionality, or remove certain features as part of the continuous evolution of the EasyHealth platform. Any such modification shall take effect immediately upon posting, unless otherwise specified.
3.2 Notification of Changes
When we make material updates to these Terms, we will take one or more of the following steps to notify you:
Posting the updated Terms within the app or on our official website;
Updating the “Last Updated” date at the top of this document;
Displaying an in-app alert, banner, or modal informing you of the changes;
Sending a push notification, in-app message, or email to the contact information associated with your account.
In certain jurisdictions, or where required by law, we may request your renewed consent to the modified Terms before allowing continued use of the Services.
3.3 Acceptance of Revised Terms
Your continued access to or use of EasyHealth following any update or modification to these Terms constitutes your full, informed, and irrevocable acceptance of the revised version.
If you do not agree to the updated Terms, you must immediately discontinue use of the Services, delete your account, and cease all interactions with EasyHealth.
We are not responsible for any damages or loss arising from your failure to review the most current version of these Terms. It is your responsibility to periodically revisit this page to stay informed of any revisions.
3.4 Historical Versions
EasyHealth maintains an internal record of prior versions of these Terms for legal and compliance purposes. However, only the version currently published in the app or on our official website shall be considered binding and enforceable.
In the event of a dispute, the Terms in effect at the time of the alleged incident or transaction will apply. Users may request the archived version applicable to their account history by contacting legal@watlu.com.
3.5 Non-Waiver of Updates
Failure by EasyHealth to immediately notify you of minor updates, typographical corrections, or clarifications shall not be deemed a waiver of the validity or enforceability of such changes. Unless otherwise stated, updates are effective upon publication and apply globally to all users, regardless of prior registration or geographic location.
3.6 Governing Interpretation
All changes made to these Terms are subject to applicable law. If a revision materially affects your rights, obligations, or the scope of Services available, we will take appropriate steps to ensure clear and timely notice in compliance with relevant consumer protection or data protection legislation (e.g., GDPR or CCPA, where applicable).
Your acknowledgment of continued access or use following any such notice constitutes affirmative consent to the revised Terms.
4. Governing Law & Jurisdiction
4.1 Applicable Law
These Terms of Service (“Terms”) and any related policies, communications, or disputes arising out of or relating to your access to or use of the EasyHealth: Vitals Tracker mobile application, website, or associated services (collectively, the “Services”) shall be governed by, and construed in accordance with, the laws of the State of Delaware, United States of America, without regard to its conflict-of-law principles or rules that might result in the application of another jurisdiction’s laws.
This choice of law applies regardless of your location, residence, or nationality, except to the limited extent that consumer protection or data protection laws of your country of residence require otherwise.
4.2 Venue and Jurisdiction
You agree that any claim, dispute, or proceeding arising out of or related to these Terms or your use of the Services shall be brought exclusively in either:
The state or federal courts located in Delaware, U.S.A., or
An arbitration tribunal seated in the United States, as provided in Section 5 (“Dispute Resolution & Arbitration”).
You hereby consent to the personal and subject-matter jurisdiction of such courts and waive any objection to venue, forum non conveniens, or inconvenience of the forum.
If you access EasyHealth from outside the United States, you acknowledge and agree that any legal action or proceeding must still be filed and resolved within the aforementioned jurisdiction unless explicitly required otherwise by applicable law.
4.3 International Users and Local Law Compliance
While EasyHealth is operated primarily from within the United States, we recognize that our users may reside in other jurisdictions.
You are solely responsible for ensuring that your access to and use of the Services complies with all local, national, and international laws, regulations, and rules that may apply to you, including but not limited to health data privacy laws and export control regulations.
If any provision of these Terms is deemed invalid or unenforceable under the laws of your jurisdiction, such provision shall be modified or severed to the minimum extent necessary to maintain its enforceability, and all remaining provisions shall remain in full force and effect.
4.4 No Extraterritorial Application
Nothing in these Terms shall be construed as granting you the benefit of, or subjecting EasyHealth to, the jurisdiction of any court, regulatory agency, or administrative body outside the United States, unless required by mandatory local law.
EasyHealth expressly disclaims any responsibility or liability for noncompliance with foreign laws arising from your use of the Services in a jurisdiction where such use is restricted or prohibited.
4.5 Conflict of Laws
To the extent that any conflict arises between applicable laws of different jurisdictions, the governing law of the State of Delaware shall prevail to the fullest extent permissible, except where local consumer rights or data protection regulations (such as the GDPR in the European Union or the CCPA in California) expressly mandate otherwise. In such cases, those specific statutory rights shall be preserved without affecting the enforceability of the remaining provisions herein.
4.6 Injunctive and Equitable Relief
You agree that any unauthorized use, access, or disclosure of the Services or EasyHealth’s intellectual property, proprietary information, or user data may cause irreparable harm to EasyHealth.
In such cases, we are entitled to seek injunctive relief or other equitable remedies in addition to any monetary damages permitted by law, without the need to post bond or prove actual damages.
4.7 Survival
This Governing Law & Jurisdiction clause shall survive termination, suspension, or expiration of these Terms and shall continue to govern any dispute, claim, or obligation that arose prior to termination of your account or cessation of use of the Services.
5. Dispute Resolution & Arbitration
5.1 Overview
EasyHealth: Vitals Tracker (“EasyHealth,” “we,” “us,” or “our”) aims to provide a transparent and fair process for resolving any disputes or concerns that may arise from your use of our Services. Most issues can and should be resolved quickly and amicably through direct communication.
Accordingly, we encourage you to first contact our support team at support@watlu.com before pursuing any formal legal action or arbitration.
5.2 Informal Resolution Requirement
Before initiating formal proceedings, you agree to make a good-faith effort to resolve any dispute, claim, or controversy (“Dispute”) with EasyHealth informally by providing written notice that includes a description of the issue, your name, account information, and a proposed resolution.
Such notice should be sent to:
EasyHealth Legal Department
Email: legal@watlu.com
Subject Line: “Dispute Resolution Notice – [Your Full Name]”
EasyHealth will respond within 30 days of receiving your notice. If we cannot reach a mutually satisfactory resolution within 60 days, either party may proceed to arbitration under the provisions below.
5.3 Binding Arbitration Agreement
You and EasyHealth agree that any Dispute arising out of or relating to:
Your access to or use of the Services;
Any aspect of your relationship with EasyHealth; or
Any product, subscription, or transaction associated with EasyHealth,
shall be resolved exclusively and finally through binding arbitration, rather than in court, except as otherwise provided in Section 5.6 (Exclusions).
Arbitration will be conducted by a neutral arbitrator, not a judge or jury, and will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect. The AAA Rules are available at www.adr.org.
5.4 Waiver of Class Actions and Jury Trials
To the fullest extent permitted by law, you and EasyHealth agree to bring Disputes only on an individual basis.
No Class Actions: Neither party may participate in a class, consolidated, or representative proceeding.
No Jury Trial: Both parties waive any right to a jury trial.
The arbitrator may not consolidate claims of multiple users or preside over any form of class or representative action.
This waiver applies to all forms of dispute resolution—whether arbitration or court proceedings—and is a fundamental condition of this agreement.
5.5 Arbitration Procedures
The arbitration shall be conducted in the English language, and unless otherwise required by law, the seat and venue shall be Delaware, United States.
The arbitrator will apply Delaware law (excluding conflict-of-law rules) and will have the authority to award any relief available under applicable law that a court of competent jurisdiction could grant, including damages, injunctive relief, and attorneys’ fees where permitted.
Each party will bear its own costs and legal fees unless the arbitrator determines that such allocation would be manifestly unfair under the circumstances. The arbitration award shall be final and binding, and judgment may be entered upon it in any court of competent jurisdiction.
5.6 Exclusions from Arbitration
The following types of claims are not subject to arbitration:
Small Claims: Either party may bring an individual action in small claims court if the claim qualifies under applicable monetary limits.
Injunctive Relief: EasyHealth may seek injunctive or equitable relief in court to prevent unauthorized use, access, or disclosure of its confidential information, data, or intellectual property.
Statutory Rights: Users in jurisdictions where arbitration clauses are restricted (such as the European Union or certain U.S. states) may exercise their statutory rights to resolve disputes in their local courts as required by law.
Nothing in this section prevents either party from seeking interim relief from a court of competent jurisdiction to protect rights pending arbitration.
5.7 Opt-Out Provision
If you do not wish to be bound by the arbitration requirement, you may opt out within 30 days of first accepting these Terms by sending a written notice to legal@watlu.com with the subject line “Arbitration Opt-Out Request.”
Your opt-out notice must include your full name, email address associated with your EasyHealth account, and a clear statement that you wish to opt out of mandatory arbitration. Opting out will not affect any other provisions of these Terms.
5.8 Location and Language
Unless both parties agree otherwise, arbitration hearings shall occur remotely or in a mutually agreed location within the United States. Proceedings shall be conducted in English, and translation services may be provided at your own expense if required.
For users outside the United States, arbitration may be conducted virtually or under international rules if required by local law.
5.9 Governing Law for Arbitration
This arbitration clause shall be interpreted, governed, and enforced under the Federal Arbitration Act (9 U.S.C. § 1 et seq.) and relevant state arbitration laws. To the extent that federal law does not apply, the laws of the State of Delaware shall govern without regard to its conflict-of-law provisions.
5.10 Severability of Dispute Clause
If any part of this Section 5 (Dispute Resolution & Arbitration) is found to be invalid, unenforceable, or contrary to applicable law, the remaining portions shall continue in full force and effect. In no event shall this clause be construed to permit arbitration on a class or representative basis.
5.11 Survival
This Section 5 shall survive the termination, suspension, or expiration of these Terms and shall continue to apply to any Dispute that arose prior to such termination or after your cessation of use of the Services.
6. Limitation of Liability
6.1 General Limitation
To the maximum extent permitted by applicable law, EasyHealth: Vitals Tracker (“EasyHealth,” “we,” “us,” or “our”), including its officers, directors, employees, affiliates, contractors, partners, licensors, and service providers, shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages of any kind whatsoever arising from or in connection with:
your access to, use of, or inability to use the Services;
any loss of data, revenue, profits, business, or goodwill;
any malfunction, bug, error, interruption, delay, or failure of the Services; or
any decision made or action taken based on information or data displayed in the EasyHealth application.
This limitation applies whether such liability is based on contract, tort, negligence, strict liability, warranty, statute, or any other legal theory, even if EasyHealth has been advised of the possibility of such damages.
6.2 Health Information Disclaimer
The Services and any data generated, displayed, or analyzed within EasyHealth are provided for informational and educational purposes only and do not constitute medical advice, diagnosis, or treatment. You should not rely on any information from EasyHealth as a substitute for professional medical consultation, diagnosis, or treatment by a qualified healthcare provider.
You acknowledge and agree that EasyHealth is not a medical device and does not perform any regulated healthcare function under FDA or other applicable medical laws. Any decisions you make based on data or insights provided by the app are entirely at your own risk.
6.3 Maximum Aggregate Liability
In no event shall the aggregate liability of EasyHealth and its affiliates arising out of or relating to these Terms or your use of the Services exceed the greater of:
(a) the total amount you paid to EasyHealth in the six (6) months preceding the event giving rise to the claim, or (b) fifty U.S. dollars (US $50) if no such payments were made.
This cap on liability applies to the maximum extent permitted by law and shall apply collectively to all claims, causes of action, and theories of liability regardless of their number or nature.
6.4 Third-Party Services and Integrations
EasyHealth may integrate with third-party services (e.g., Apple Health, Google Fit, Stripe, Supabase). We do not control, endorse, or assume responsibility for any acts, omissions, or negligence of such third parties. To the fullest extent permitted by law, EasyHealth disclaims all liability arising from your use of or reliance upon any third-party platforms or data sources connected to our Services.
6.5 No Warranty or Guarantee
The Services are provided on an “as is” and “as available” basis without any warranties of any kind, whether express, implied, or statutory, including but not limited to any warranty of merchantability, fitness for a particular purpose, title, accuracy, quiet enjoyment, or non-infringement. We make no representation or warranty that:
the Services will be uninterrupted, secure, or error-free;
any defects or errors will be corrected; or
the results or insights you obtain from EasyHealth will be accurate or reliable.
You use EasyHealth at your own discretion and risk.
6.6 User’s Risk and Responsibility
You acknowledge that your use of EasyHealth involves the collection and storage of sensitive health information. While we employ industry-standard security measures, you understand that no system can guarantee absolute protection against unauthorized access, loss, or breach. By using EasyHealth, you assume all risk for your reliance on app-generated insights and for the security of your devices and credentials.
6.7 Jurisdiction-Specific Limitations
Because some jurisdictions do not allow certain limitations of liability or exclusion of implied warranties, some of the above limitations may not apply to you. In such cases,
EasyHealth’s liability shall be limited to the minimum extent required by applicable law, and these Terms shall be interpreted to preserve their intended legal effect to the greatest extent possible.
6.8 Survival
This Limitation of Liability section shall survive termination, suspension, or expiration of your account or these Terms and shall continue to apply to any claims arising from events that occurred during your use of the Services.
7. Indemnification
7.1 User Obligation
You agree to defend, indemnify, and hold harmless EasyHealth: Vitals Tracker (“EasyHealth,” “we,” “us,” or “our”) and its respective officers, directors, shareholders, employees, contractors, affiliates, licensors, partners, and service providers (collectively, the “Indemnified Parties”) from and against any and all claims, demands, actions, suits, proceedings, losses, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees, expert fees, and court costs) arising out of or relating to:
Your use or misuse of the Services;
Your violation of these Terms of Service or any other applicable policy or guideline referenced herein;
Your violation of any law, regulation, or third-party right, including but not limited to data protection, intellectual property, or privacy rights;
Any content, data, or materials you submit, upload, or transmit through the Services;
Any fraudulent, negligent, or intentional act or omission by you or anyone accessing your account with or without authorization.
This indemnification obligation applies to all forms of access and use, whether via mobile device, API, browser, or third-party integration.
7.2 Defense and Control of Claims
EasyHealth reserves the exclusive right, at its sole discretion, to assume the defense and control of any claim or proceeding subject to indemnification under this Section, at your expense.
You agree to fully cooperate with EasyHealth in the defense or settlement of any such claim, including providing relevant documentation, account records, correspondence, or evidence as reasonably requested. You may not settle or compromise any claim in a manner that imposes any obligation or liability on EasyHealth without our prior written consent.
7.3 Scope of Indemnity
Your indemnification obligations under this Section extend to claims arising from:
Data misuse, unauthorized sharing, or disclosure of personal or health information entered into the app;
Misrepresentation or falsification of data that leads to harm, damages, or third-party disputes;
Uploading or distributing harmful, malicious, or infringing content;
Improper reliance on the Services for medical, diagnostic, or therapeutic decisions contrary to Section 6.2 (“Health Information Disclaimer”).
This clause remains enforceable regardless of whether the claim is based on contract, tort, statute, negligence, or any other legal theory.
7.4 Third-Party Platforms and Integrations
If your actions or omissions involving any third-party platform or integration (such as Apple Health, Google Fit, Supabase, Stripe, or other connected services) result in a claim, investigation, or liability, you agree to indemnify and hold harmless EasyHealth to the same extent as if the conduct occurred directly within our Services.
7.5 Limitation of EasyHealth’s Responsibility
While EasyHealth will make reasonable efforts to notify you of any claim subject to indemnification, our failure to do so shall not relieve you of your obligations under this Section, except to the extent that such failure materially prejudices your ability to defend the claim.
We are not required to seek or obtain insurance or reimbursement before enforcing our rights to indemnification hereunder.
7.6 Independent Obligations
Your indemnification obligations are independent of any other rights or remedies available to EasyHealth under these Terms or applicable law.
They survive the termination, suspension, or expiration of your account and remain enforceable for the full statutory period permitted under law.
7.7 No Limitation of Other Remedies
This Section shall not limit or restrict any other legal rights or remedies available to EasyHealth, including claims for equitable relief, injunction, or recovery of damages under Section 6 (“Limitation of Liability”).
8. Eligibility & Account Requirements
8.1 Minimum Age and Capacity
To access or use EasyHealth: Vitals Tracker (“EasyHealth,” “we,” “us,” or “our”), you must meet the minimum age and legal capacity requirements established by applicable law.
You represent and warrant that you are at least 13 years old, or 16 years old where required by local or regional law, and that you have the full legal right, power, and capacity to enter into this binding agreement and comply with these Terms of Service (“Terms”).
If you are below the age of legal majority in your jurisdiction, you may use the Services only under the supervision of a parent or legal guardian who has reviewed and accepted these Terms on your behalf. The parent or guardian is fully responsible for the minor’s use of the Services, including all submissions, data entries, and in-app purchases.
EasyHealth does not knowingly allow individuals under 13 to create accounts or submit personal or health information. If we learn that a child under this age has provided such data, we will promptly delete the account and associated records in accordance with Section 11 (Data Control, Retention & Deletion) and our Privacy Policy.
8.2 Legal Authority and Representation
By accessing or using the Services, you affirm that:
You are not barred from using digital health-tracking applications under any applicable law, regulation, or sanction program (including OFAC or EU-level restrictions).
You will use EasyHealth solely for lawful, personal health-tracking and wellness purposes.
You are acting on your own behalf and not as an agent or representative of another person or entity unless you are expressly authorized to do so.
If you use EasyHealth on behalf of an organization, employer, medical institution, or wellness program, you represent and warrant that you have the full legal authority to bind that entity to these Terms. In such cases, references to “you” and “your” shall include both the individual user and the represented organization. The organization assumes full responsibility for all account activity conducted under its authorization.
8.3 Account Creation and Verification
Certain features of EasyHealth require registration and creation of a user account.
When registering, you must provide accurate, current, and complete information and maintain it throughout your use of the Services. You agree not to use false, misleading, or impersonated details, and you must not create an account on behalf of another person without their explicit consent.
EasyHealth reserves the right to verify your identity, request supporting documentation, or refuse account creation if necessary to comply with data-protection, age-verification, or anti-fraud laws. Failure to provide requested verification may result in suspension or termination under Section 10 (User Conduct & Termination).
8.4 Compliance with Laws
You are solely responsible for ensuring that your access to and use of EasyHealth comply with all local, national, and international laws, including those governing health-data handling, digital communications, and online privacy.
You agree not to use the Services in any jurisdiction where doing so would violate applicable law or expose EasyHealth to regulatory penalties or legal obligations.
8.5 Eligibility Review and Revocation
EasyHealth reserves the right, at any time and at its sole discretion, to review, restrict, or revoke a user’s eligibility to access or use the Services if we have reason to believe that:
You have provided false, incomplete, or misleading information during registration;
You are using the Services in a prohibited jurisdiction;
You are under the legal minimum age required for use; or
Your continued use presents a risk to the integrity, security, or legal compliance of EasyHealth or its users.
In such cases, we may suspend or permanently disable your account without prior notice, consistent with applicable law.
8.6 No Transfer of Accounts
User accounts are personal, non-transferable, and may not be sold, assigned, shared, or sublicensed. Any attempt to transfer ownership, sell account credentials, or provide unauthorized access to another party constitutes a material breach of these Terms and may result in immediate termination of access.
8.7 Survival
This Eligibility & Account Requirements section shall survive the deactivation, suspension, or termination of your account and shall continue to apply to any obligations or representations made prior to termination.
9. Account Registration & Security
9.1 Account Creation
Certain features and functionalities of EasyHealth: Vitals Tracker (“EasyHealth,” “we,” “us,” or “our”) require you to create a registered user account (“Account”).
When registering, you agree to provide accurate, complete, and current information about yourself, including a valid email address or authentication method (such as Apple Sign In or Google Sign-In). You further agree to promptly update your information if it changes to ensure accuracy at all times.
You may not create an account using a false identity, another person’s credentials, or information that you are not legally authorized to use. EasyHealth reserves the right to reject, suspend, or delete any account registration that we reasonably believe violates these Terms or applicable law.
9.2 Authentication and Access
By creating an Account, you authorize EasyHealth to associate all data, activity, and health records submitted under your credentials with your registered profile. You are solely responsible for maintaining the confidentiality of your login credentials, including any passwords, PINs, recovery codes, or linked third-party authentication tokens.
You must not share your password or allow others to access your Account under any circumstances. If you suspect that your password has been compromised or that unauthorized access has occurred, you must immediately change your password and notify us at support@watlu.com.
EasyHealth will never ask you for your password via email, text, or phone. Any such request should be treated as suspicious and reported immediately.
9.3 Account Responsibility
You are fully responsible for all activity conducted through your Account, including actions taken by anyone who accesses it, with or without your authorization.
This includes—but is not limited to—any data submissions, settings changes, purchases, or transmissions made under your credentials.
If you access the Services on behalf of another individual or organization (such as a family member or health program), you represent that you have explicit authorization to do so and accept full responsibility for all associated actions.
EasyHealth disclaims liability for losses or damages resulting from unauthorized account access arising from your failure to maintain adequate security over your device, login credentials, or connected services.
9.4 Security of Devices and Connections
You are responsible for securing the devices you use to access EasyHealth and ensuring that you connect through trusted, encrypted networks.
You acknowledge that using public Wi-Fi, unsecured networks, or compromised devices may increase the risk of unauthorized access to your Account or data.
While EasyHealth employs industry-standard encryption, secure session tokens, and protected storage, you understand that no digital platform can guarantee absolute security. By using the Services, you accept these inherent risks.
9.5 Multiple Devices and Syncing
If you use EasyHealth across multiple devices, you acknowledge that synchronization relies on secure communication between your Account and our cloud infrastructure.
You are responsible for ensuring that all devices linked to your Account are secured, updated, and free from malware or unauthorized monitoring tools. EasyHealth shall not be liable for any breach or data exposure originating from compromised personal devices or external platforms connected to your Account.
9.6 Unauthorized Use and Account Suspension
If EasyHealth determines that your Account has been compromised, used fraudulently, or involved in suspicious activity, we reserve the right to temporarily suspend or permanently disable your access to protect you, other users, and the integrity of the Services.
We may also suspend your Account for reasons including—but not limited to—noncompliance with these Terms, suspected fraud, system abuse, repeated failed login attempts, or legal obligations to restrict access.
Upon resolution, reinstatement may be considered at EasyHealth’s discretion.
9.7 Deactivation and Account Closure
You may deactivate or permanently delete your Account at any time through the in-app settings or by contacting our support team at support@watlu.com.
Upon deletion, all personal data and Health Data associated with your Account will be handled in accordance with Section 11 (Data Control, Retention & Deletion) and our Privacy Policy.
Please note that certain transactional or legal records may be retained for compliance purposes, as described in our data retention policy.
9.8 Account Ownership Disputes
In the event of a dispute over account ownership, EasyHealth reserves the right to determine rightful ownership based on available information such as registration details, linked payment credentials, and verified contact information. Our determination shall be final and binding unless otherwise required by law.
9.9 Survival
Your obligations under this section—including maintaining accurate information, safeguarding credentials, and promptly reporting breaches—shall survive termination or deletion of your Account and remain enforceable under these Terms.
10. User Conduct & Termination
10.1 Standards of Conduct
By accessing or using EasyHealth: Vitals Tracker (“EasyHealth,” “we,” “us,” or “our”), you agree to behave responsibly and lawfully at all times. You must not use, attempt to use, or encourage others to use the Services in any way that could harm EasyHealth, its users, or any third party, or interfere with the normal operation, integrity, or security of our systems.
You agree that you will not, under any circumstances:
Violate any applicable law or regulation, including those governing health data, digital communications, or consumer protection;
Use the Services to submit false, misleading, or fraudulent health data;
Access or attempt to access another user’s account, data, or information without authorization;
Circumvent, disable, or tamper with any security or authentication mechanisms implemented by EasyHealth;
Reverse engineer, decompile, or otherwise interfere with any part of the app’s source code or system architecture;
Transmit malware, scripts, or harmful code, or perform denial-of-service (DoS) attacks on EasyHealth’s servers or connected infrastructure;
Upload or distribute unlawful, defamatory, harassing, threatening, abusive, obscene, or invasive content through the Services;
Use EasyHealth for commercial, advertising, or resale purposes unless explicitly authorized in writing;
Engage in any activity intended to manipulate app performance, analytics, or service availability;
Misrepresent yourself, your identity, or your affiliation with any person or entity when using the Services.
Violation of any of these prohibitions constitutes a material breach of these Terms and may result in immediate suspension or termination under Section 10.4 below.
10.2 Compliance with Local and International Laws
You agree to use EasyHealth only in jurisdictions where its use is legal and compliant with applicable laws. It is solely your responsibility to understand and comply with local, state, national, and international regulations governing digital health tracking, data privacy, and cross-border data transfers.
EasyHealth disclaims all liability for your noncompliance with regional laws or unauthorized use of the Services in prohibited territories.
10.3 Monitoring and Enforcement
EasyHealth reserves the right, but not the obligation, to monitor, audit, or investigate user activity, data submissions, and account usage patterns to ensure compliance with these Terms, detect abuse, and protect the integrity of the platform.
We may, in our sole discretion, take any of the following actions without prior notice:
Suspend or terminate your access to the Services;
Restrict certain functionalities or data access;
Remove, anonymize, or block any submitted content;
Report suspected violations to law enforcement or regulatory authorities;
Cooperate with court orders, subpoenas, or investigations when legally required.
We may also use automated systems to detect suspicious or abusive behavior patterns. You acknowledge and consent to such monitoring practices as a condition of using the Services.
10.4 Suspension and Termination by EasyHealth
EasyHealth may, at its sole discretion and without liability to you, suspend, restrict, or terminate your Account or access to the Services at any time, with or without notice, for any of the following reasons:
Violation of these Terms or any applicable law;
Unauthorized or fraudulent use of your Account;
Submission of false, incomplete, or misleading information;
Security breaches, account compromise, or risk to other users;
Prolonged inactivity (as defined by EasyHealth policy);
Requests from law enforcement, regulators, or judicial authorities;
Technical, operational, or maintenance reasons requiring suspension;
Any conduct deemed harmful to EasyHealth, its systems, or its reputation.
Upon termination, your right to access and use the Services ceases immediately. All personal data will be handled in accordance with Section 11 (Data Control, Retention & Deletion) and our Privacy Policy.
10.5 User-Initiated Termination
You may voluntarily close or delete your Account at any time by using the in-app account settings or by submitting a written request to support@watlu.com.
Once processed, your account data and stored health information will be deleted or anonymized consistent with our data retention and deletion practices.
Please note that termination is permanent and may not be reversible. Any purchases or subscriptions made through the App Store or Google Play will remain governed by their respective platform terms.
10.6 Effect of Termination
Upon termination (whether initiated by you or by EasyHealth):
All licenses and rights granted under these Terms immediately cease;
You must discontinue all access to and use of the Services;
Any remaining obligations or accrued rights under these Terms shall survive, including payment obligations, liability limitations, and indemnification duties.
Termination does not relieve either party of obligations incurred prior to the effective termination date.
EasyHealth shall not be liable for any damages, losses, or inconvenience resulting from suspension or termination of your Account.
10.7 Appeal and Reinstatement
If your Account is terminated or suspended, you may submit a written appeal within 30 days of receiving notice by contacting support@watlu.com with the subject line “Account Termination Appeal.”
Your appeal should include your name, registered email, and a detailed explanation of the circumstances. EasyHealth will review the appeal and respond in good faith, though reinstatement is not guaranteed and shall remain at our sole discretion.
10.8 Survival of Terms
The following sections of these Terms shall survive termination or expiration of your Account:
Section 5 (Dispute Resolution & Arbitration)
Section 6 (Limitation of Liability)
Section 7 (Indemnification)
Section 10 (User Conduct & Termination)
Section 11 (Data Control, Retention & Deletion)
Section 15 (Miscellaneous Provisions)
These clauses remain enforceable to protect EasyHealth’s rights and ensure ongoing legal compliance.
11. Data Control, Retention & Deletion
11.1 User Ownership and Control
You are the primary owner and controller of all personal and health data (“Health Data”) that you manually enter, upload, or generate through the EasyHealth: Vitals Tracker app (“EasyHealth,” “we,” “us,” or “our”).
We believe your data belongs to you — not to us — and you maintain full control over how it is stored, viewed, or deleted.
You may access, export, correct, or delete your personal and Health Data at any time through the app’s account settings or by contacting our support team at support@watlu.com. Once we verify your identity, we will process your request in accordance with applicable data protection laws.
11.2 Data Categories We Store
The types of information we may store include:
Account Information: such as your name, email address, and authentication credentials.
Health Data: vitals and wellness information that you manually enter (e.g., blood pressure, glucose, cholesterol, weight, heart rate, medication logs).
Device and Usage Data: technical metadata such as device identifiers, app version, IP address, crash logs, and session analytics used for performance optimization.
Transactional Data: records related to app subscriptions or in-app purchases, where applicable, for accounting and regulatory compliance.
We do not sell, rent, or broker your personal or health data under any circumstance.
11.3 Data Processing and Purpose Limitation
We only process your personal and Health Data for specific, legitimate purposes that include:
Providing and maintaining the Services and your personalized dashboard;
Syncing, backing up, and securing your account data;
Generating visualizations, summaries, and insights within the app;
Complying with legal, regulatory, or financial recordkeeping obligations; and
Improving product reliability, usability, and safety through anonymized analytics.
All processing is carried out under the legal bases permitted by applicable laws (e.g., your consent under GDPR Article 6(1)(a) or legitimate interest under Article 6(1)(f)).
11.4 Data Retention Period
We retain your personal and Health Data only for as long as necessary to fulfill the purposes for which it was collected, or as required by law.
Specifically:
Active account data is retained until you delete your account or request removal.
Backup copies and audit logs may be securely retained for a limited period (typically up to 90 days) for recovery, fraud prevention, and compliance verification.
Payment and transaction records are retained for up to seven (7) years as required by accounting, audit, and tax laws.
Aggregated or anonymized data that cannot reasonably identify you may be retained indefinitely for research and statistical purposes.
11.5 Account Deletion and Data Erasure Requests
You may request permanent deletion of your account and associated data at any time by:
Selecting “Delete Account” within the in-app settings, or
Sending a written request to support@watlu.com with the subject line “Data Deletion Request.”
Upon receipt, EasyHealth will:
Verify your identity to ensure the request is legitimate;
Remove or anonymize all personal and Health Data within 30 days (or sooner, as required by law);
Notify you via email once deletion is complete.
Please note that deletion is irreversible and will result in the permanent loss of all stored metrics, insights, and progress logs associated with your account.
Certain limited records (e.g., transaction receipts, security logs) may be retained as required by legal, tax, or auditing obligations.
11.6 Temporary Retention for Security or Legal Reasons
EasyHealth may temporarily retain certain data beyond deletion requests if necessary to:
Comply with ongoing legal proceedings, government requests, or audits;
Detect, prevent, or investigate fraud, abuse, or security incidents;
Ensure the integrity of user deletion requests or system recovery.
Such retention shall be strictly time-limited and handled in compliance with data minimization and purpose limitation principles.
11.7 Data Portability
You have the right to request a copy of your Health Data in a structured, commonly used, and machine-readable format (e.g., CSV or JSON) for portability or personal recordkeeping.
We will process data export requests within a reasonable timeframe, typically within 30 days, unless otherwise extended due to complexity or volume.
11.8 Backup and Recovery Systems
To protect user data from accidental loss or corruption, EasyHealth maintains secure, encrypted backups.
Backups are stored on trusted cloud infrastructure providers that comply with international security standards (such as ISO 27001 or SOC 2 Type II).
Backup data is automatically purged after the retention period expires, and deleted accounts are excluded from future backup cycles.
11.9 Anonymization and Aggregation
After account deletion or expiration, EasyHealth may convert certain personal and Health Data into aggregated or anonymized forms that are no longer identifiable to any individual.
Such data may be used for legitimate purposes including research, service optimization, or trend reporting, in full compliance with privacy laws.
11.10 Compliance with Data Protection Laws
EasyHealth operates in accordance with major global privacy frameworks, including but not limited to:
The General Data Protection Regulation (GDPR) (EU 2016/679);
The California Consumer Privacy Act (CCPA);
The Health Insurance Portability and Accountability Act (HIPAA) principles, where applicable; and
Other regional privacy and data retention standards.
We continuously review and update our data governance practices to maintain transparency, accountability, and regulatory compliance.
11.11 Survival
This section shall survive the termination, suspension, or expiration of your account and continue to apply to any retained data as required by law or for legitimate business needs consistent with these Terms and the Privacy Policy.
12. Privacy Policy Reference
12.1 Relationship Between the Terms and Privacy Policy
Your privacy and data security are core principles of the EasyHealth: Vitals Tracker platform (“EasyHealth,” “we,” “us,” or “our”). These Terms of Service (“Terms”) are intended to be read together with our Privacy Policy, which forms an integral and legally binding part of this agreement.
By accessing, installing, registering for, or using the Services, you acknowledge that you have read, understood, and agreed to be bound by both this Terms of Service and the Privacy Policy.
12.2 Overview of the Privacy Policy
Our Privacy Policy describes in detail how we:
Collect information you provide directly (such as account details, contact info, and manually entered health data);
Automatically gather device information, usage analytics, and technical logs;
Use this information to operate, improve, and personalize the Services;
Share limited data only with trusted third-party processors (e.g., Stripe, Supabase, or analytics providers) strictly under confidentiality and security obligations;
Protect your personal and health information through encryption, secure transmission protocols, and strict access controls; and
Comply with applicable data protection laws, including GDPR, CCPA, and other regional privacy frameworks.
Your continued use of EasyHealth signifies your explicit consent to our data practices as outlined in the Privacy Policy.
12.3 User Rights and Control
Our Privacy Policy also explains your rights regarding your personal and Health Data, which may include:
The right to access and obtain a copy of your stored data;
The right to rectify or correct inaccurate information;
The right to request deletion or anonymization of your data;
The right to withdraw consent or restrict certain forms of processing; and
The right to data portability, allowing you to export your information in a machine-readable format.
Requests to exercise these rights may be submitted directly within the app or by contacting our Data Protection Team at support@watlu.com.
12.4 Third-Party Links and External Policies
EasyHealth may include integrations, data imports, or optional connections to third-party services (such as Apple Health or Google Fit). These services operate under their own privacy policies, and we encourage you to review them carefully.
We do not control or assume responsibility for the data-handling practices of external platforms, even when accessed through the EasyHealth interface.
12.5 Updates to the Privacy Policy
Our Privacy Policy may be updated periodically to reflect new features, legal requirements, or improvements in our data protection practices.
When material changes occur, we will update the “Last Updated” date at the top of the Privacy Policy, and may provide in-app or email notifications where required by law. Your continued use of the Services after such updates constitutes your acknowledgment and acceptance of the revised policy.
12.6 Survival
This Section and your obligations to review and comply with the Privacy Policy shall survive the termination, suspension, or expiration of your Account.
13. Security & Breach Notification
13.1 Commitment to Data Protection
EasyHealth: Vitals Tracker (“EasyHealth,” “we,” “us,” or “our”) takes the protection, integrity, and confidentiality of your personal and health data seriously. We employ administrative, technical, and physical safeguards designed to secure your information from unauthorized access, alteration, disclosure, or destruction.
Our security program is structured around global best practices — including encryption, access minimization, network segmentation, and continuous monitoring — to ensure the confidentiality, availability, and integrity of all data processed through our systems.
13.2 Encryption and Secure Transmission
All communications between your device and our servers are protected using Transport Layer Security (TLS 1.2 or higher) and HTTPS encryption protocols.
Sensitive data, such as authentication tokens and health metrics, are encrypted both in transit and at rest using modern cryptographic standards (AES-256 or equivalent).
We also employ key rotation, data isolation, and token-based access control to further minimize risk. Access to health or personal data within our systems is strictly limited to authorized personnel with legitimate operational needs, subject to confidentiality and security training requirements.
13.3 Infrastructure and Access Controls
Our backend infrastructure is hosted on secure cloud environments that comply with leading security certifications, such as ISO/IEC 27001, SOC 2 Type II, and GDPR-compliant frameworks.
We use role-based access control (RBAC) to ensure that employees and contractors only access data necessary for their duties. Multi-factor authentication (MFA), session timeouts, and automatic account lockouts are enforced internally to prevent unauthorized administrative access.
We also maintain real-time intrusion detection, network firewalls, and anomaly monitoring systems to detect and respond to suspicious activity.
13.4 Incident Response and Breach Management
In the unlikely event that EasyHealth experiences a data breach, unauthorized disclosure, or security incident that compromises the confidentiality, integrity, or availability of your personal or health data, we will act swiftly and transparently.
Our incident response protocol includes:
Immediate containment of the breach and assessment of its scope;
Investigation and forensic analysis to determine root cause and affected systems;
Remediation and patching of vulnerabilities to prevent recurrence; and
Notification to affected users and regulatory authorities as required by law.
If the breach is likely to result in a risk to your rights or freedoms (as defined by GDPR Article 33), we will notify you without undue delay — and, where legally required, within 72 hours of becoming aware of the incident.
13.5 User Responsibilities
While EasyHealth maintains robust security measures, users also play a critical role in protecting their data. You agree to:
Use strong, unique passwords for your account and device;
Keep your login credentials private and secure;
Avoid using EasyHealth on shared or untrusted devices; and
Report any suspected unauthorized access or unusual activity to support@watlu.com immediately.
Failure to maintain reasonable security hygiene may increase your risk of exposure and limit EasyHealth’s ability to protect your data effectively.
13.6 No Absolute Guarantee
While we implement industry-standard measures, you acknowledge that no system is completely immune to unauthorized intrusion or breach. By using EasyHealth, you accept this inherent risk and agree that EasyHealth shall not be held liable for incidents arising from factors beyond our reasonable control, including network outages, third-party infrastructure failures, or malicious acts by external attackers.
13.7 Cooperation with Regulators and Authorities
In the event of a significant security incident, EasyHealth may cooperate with law enforcement, data protection authorities, and other relevant agencies.
We will provide all legally required information and take appropriate steps to mitigate the impact on affected users and restore service integrity as quickly as possible.
13.8 Ongoing Security Improvements
We regularly evaluate, audit, and enhance our security infrastructure through:
Annual third-party penetration testing;
Continuous vulnerability scanning;
Employee security training and certifications; and
Periodic review of encryption standards and access controls.
We maintain a Security and Compliance Register documenting all relevant controls and safeguards as part of our continuous compliance program.
13.9 Survival
This Section shall survive termination or expiration of your account and continue to apply to any retained or archived data as long as EasyHealth maintains possession of such information for lawful purposes.
14. International Use & Legal Compliance
14.1 Global Availability of Services
EasyHealth: Vitals Tracker (“EasyHealth,” “we,” “us,” or “our”) is operated and maintained primarily within the United States, but our Services may be accessible to users in other countries or territories.
By using EasyHealth outside the U.S., you acknowledge that our Services are governed by U.S. laws and regulations, and that certain data-handling practices may differ from those in your country of residence.
You are solely responsible for ensuring that your access to and use of EasyHealth complies with all local, national, and international laws, including those governing data protection, digital health, consumer rights, and export controls.
14.2 International Data Transfers
To operate efficiently and provide a seamless user experience, EasyHealth may transfer, process, or store your data (including personal and health data) on servers located in the United States or other countries where we or our trusted service providers maintain facilities.
When transferring personal data across borders, EasyHealth ensures that such transfers comply with applicable international data protection laws and frameworks, including:
The EU–U.S. Data Privacy Framework (DPF), for transfers from the European Union and United Kingdom to the United States;
The Standard Contractual Clauses (SCCs) adopted by the European Commission (where applicable); and
Any equivalent or successor mechanisms recognized under global privacy legislation.
We implement appropriate technical and organizational safeguards, such as encryption, access restrictions, and contractual data protection obligations, to ensure your information remains secure and protected regardless of where it is processed.
14.3 Local Compliance Responsibility
If you access or use EasyHealth from outside the United States, you do so at your own initiative and are solely responsible for:
Determining whether local laws permit your use of EasyHealth;
Ensuring compliance with health data regulations, consumer rights laws, and privacy frameworks in your region;
Avoiding prohibited or restricted use of the Services under local or international export laws; and
Bearing any costs, taxes, or obligations arising from your jurisdiction’s requirements.
EasyHealth does not guarantee that the Services or their features are appropriate, lawful, or available in all locations.
We reserve the right to restrict or limit access to certain features, content, or jurisdictions to comply with regional laws or sanctions programs.
14.4 Cross-Border Regulatory Cooperation
EasyHealth complies with all applicable export control, sanctions, and trade compliance laws, including those administered by the U.S. Department of Commerce, Office of Foreign Assets Control (OFAC), and European Commission.
You agree not to access or use the Services if you are located in a region subject to comprehensive U.S. sanctions (e.g., North Korea, Iran, Cuba, Syria, or Crimea region) or are listed on any U.S. or international restricted party list.
We may disclose information to appropriate regulatory bodies or law enforcement agencies as required by applicable international law.
14.5 GDPR and Regional Privacy Compliance
If you are located in the European Union (EU), European Economic Area (EEA), United Kingdom, Canada, or other jurisdictions with privacy protections similar to the GDPR, you are entitled to specific rights and protections concerning your personal data.
These include:
The right to access and obtain a copy of your personal data;
The right to correct inaccuracies or incomplete data;
The right to request deletion (“right to be forgotten”);
The right to restrict or object to processing; and
The right to data portability in a structured, commonly used format.
To exercise these rights, please contact our Data Protection Officer via support@watlu.com. We will respond to all lawful requests within the timeframes required by applicable regulation.
14.6 Data Storage Location and Legal Jurisdiction
All personal and Health Data collected through EasyHealth is stored on secure, U.S.-based cloud infrastructure managed by reputable providers compliant with ISO 27001, SOC 2, and GDPR data protection standards.
By using our Services, you consent to the transfer and processing of your data in the United States and other jurisdictions where EasyHealth or its service providers operate.
If local data residency laws in your jurisdiction prohibit such transfers, you must refrain from using the Services or request a localized storage arrangement (where available).
14.7 Compliance with Healthcare and Consumer Regulations
EasyHealth is not a medical device and does not claim to diagnose, treat, or prevent any condition. However, we adhere to health data handling principles aligned with HIPAA (Health Insurance Portability and Accountability Act of 1996) and equivalent frameworks, where applicable, to ensure proper confidentiality, integrity, and security of all Health Data.
We also comply with regional consumer and e-commerce laws, including transparency requirements under the California Consumer Privacy Act (CCPA) and UK Consumer Rights Act.
14.8 Termination for Non-Compliance
EasyHealth reserves the right to suspend or terminate access to users or jurisdictions where continued operation would violate applicable laws, sanctions, or regulatory directives.
This includes disabling accounts found to be using VPNs, proxies, or false registration details to circumvent geographic restrictions.
14.9 Survival
This Section shall survive the termination, expiration, or deactivation of your Account and continue to govern the treatment and transfer of any retained data consistent with these Terms and our Privacy Policy.
15. Miscellaneous (Severability, Waiver, Assignment, Force Majeure, Feedback, Contact Info)
15.1 Severability
If any provision, clause, sentence, or portion of these Terms of Service (“Terms”) is found to be invalid, unlawful, or unenforceable by a court or authority of competent jurisdiction, the remainder of the Terms shall remain in full force and effect.
Where permissible, the invalid or unenforceable provision shall be interpreted or modified to reflect the original intent of the parties as closely as possible, consistent with applicable law.
This severability principle applies regardless of whether the invalid term relates to jurisdictional differences, consumer protection laws, or data privacy regulations.
The surviving provisions of these Terms will continue to govern your use of EasyHealth.
15.2 Waiver
No delay, omission, or failure by EasyHealth: Vitals Tracker (“EasyHealth,” “we,” “us,” or “our”) to enforce or exercise any right, remedy, or condition under these Terms shall constitute a waiver of such right or condition, nor shall it prevent or limit EasyHealth from enforcing the same right at a later time.
Any waiver must be expressly made in writing and signed by an authorized representative of EasyHealth to be valid. A single or partial exercise of any right shall not preclude further exercise of that or any other right.
Your continued use of the Services after a breach does not constitute waiver of enforcement.
15.3 Assignment
You may not assign, delegate, sublicense, or otherwise transfer your rights or obligations under these Terms without EasyHealth’s prior written consent. Any attempted transfer or assignment in violation of this clause is void.
EasyHealth may freely assign or transfer these Terms, in whole or in part, without your consent:
To a parent company, affiliate, or subsidiary;
In connection with a merger, acquisition, asset sale, or reorganization; or
To a successor entity continuing EasyHealth’s business.
These Terms shall bind and benefit both parties and their respective permitted successors and assigns.
15.4 Force Majeure
EasyHealth shall not be held liable for any failure or delay in performing its obligations under these Terms resulting from events or circumstances beyond its reasonable control (“Force Majeure Events”).
Such events include, but are not limited to:
Natural disasters (e.g., earthquakes, floods, hurricanes, wildfires);
War, terrorism, riots, or civil unrest;
Government actions, embargoes, or sanctions;
Cyberattacks, system breaches, or widespread internet outages;
Strikes, labor disputes, or industrial disruptions;
Power grid failures or infrastructure breakdowns;
Public health crises, pandemics, or declared emergencies.
During a Force Majeure Event, EasyHealth’s obligations shall be suspended for the duration of the event, and we will make reasonable efforts to resume normal operations as soon as possible.
If the event continues for more than sixty (60) days and substantially prevents performance, EasyHealth may terminate affected Services without further liability, except for fees or obligations already incurred.
15.5 Feedback and Suggestions
We welcome and appreciate your ideas, comments, and suggestions regarding EasyHealth and its Services (“Feedback”).
By submitting Feedback, you agree that:
EasyHealth may freely use, reproduce, adapt, modify, distribute, or implement the Feedback without any obligation, compensation, or restriction;
Your Feedback does not contain confidential or proprietary information of any third party; and
You grant EasyHealth a perpetual, irrevocable, royalty-free, worldwide license to use and incorporate the Feedback into current or future products, features, or documentation.
This clause ensures that innovation and improvement remain continuous, while maintaining full ownership of your personal data and health information as described in Section 11.
15.6 Governing Language
These Terms and all related policies are drafted in English, which shall be the controlling language for interpretation, enforcement, and dispute resolution. Any translation provided is for convenience only and does not alter the meaning of the English version.
